How can you be "legally drunk"?

Legally drunk is simply the government definition of drunk. A man or woman who can hardly stand up or walk or speak in cohesive sentences is quite obviously drunk. Someone legally drunk however may be able to do all those things quite well and show no obvious signs of intoxication other than a smell of alcohol on their breath. Therefore state sets a blood alcohol level (usually.08) as the legal definition of drunk. This allows an arrest to be made and a difficult almost impossible case to defend in court. The question of drunkenness is answered by the legal definition and if you were .08 you were by law, drunk. A jury would have no choice based on the law but to find you guilty.
