It shall be unlawful for any person to drive or operate any motor vehicle, engine or train (i) while such person has a blood alcohol concentration of 0.08 percent or more by weight by volume or 0.08 grams or more per 210 liters of breath as indicated by a chemical test administered as provided in this article, (ii) while such person is under the influence of alcohol, (iii) while such person is under the influence of any narcotic drug or any other self-administered intoxicant or drug of whatsoever nature, or any combination of such drugs, to a degree which impairs his ability to drive or operate any motor vehicle, engine or train safely, (iv) while such person is under the combined influence of alcohol and any drug or drugs to a degree which impairs his ability to drive or operate any motor vehicle, engine or train safely, or (v) while such person has a blood concentration of any of the following substances at a level that is equal to or greater than: (a) 0.02 milligrams of cocaine per liter of blood, (b) 0.1 milligrams of methamphetamine per liter of blood, (c) 0.01 milligrams of phencyclidine per liter of blood, or (d) 0.1 milligrams of 3,4-methylenedioxymethamphetamine per liter of blood. A charge alleging a violation of this section shall support a conviction under clauses (i), (ii), (iii), (iv), or (v).

About The Author

A Virginia native, Michael was born and raised in Christiansburg, Virginia. Michael attended Radford University where he majored in Political Science and minored in English. After college, Michael worked for several years, saving money for law school. He then moved to Virginia Beach with his wife, and he began his legal studies at Regent University in Virginia Beach.

After law school, Michael took and passed the Virginia Bar Exam on his first try; a true accomplishment considering Virginia is one of the nation’s hardest bars exams to pass. After passing the bar, Michael began his legal career in the Newport News Office of the Commonwealth’s Attorney. There, Michael was assigned to the Juvenile and Domestic Relations (J&DR) team where he was responsible for the prosecution of misdemeanor and felony cases in the J&DR Court and Circuit Court. While serving in that position, Michael prosecuted thousands of cases involving: domestic violence, violation of protective orders, drug possession and distribution, larcenies, robberies, malicious and unlawful wounding, rape, child sex crimes, and probation violations – just to name a few.

While Michael loved the Commonwealth Attorney’s Office in Newport News, his wife received a wonderful job opportunity in McLean, Virginia. At that point, he sought jobs in Northern Virginia which would allow him to continue to prosecute. Michael and his family moved to Northern Virginia and he picked up where he left off, prosecuting in Fauquier County (Warrenton), Virginia. While there, Michael prosecuted cases in the General District Court (GDC), the J&DR Court, and the Circuit Court. His cases varied from common traffic violations to serious felonies.

Michael left the Commonwealth Attorney’s Office in Fauquier to open Robinson Law, PLLC. An Introduction To California Dui Laws

In California, the DUI laws are written under the California Vehicle Code VC 23152 Alcohol and/or Drugs. The DUI law was codified back in 1935. The law distinguishes between a misdemeanor and felony. According to its definition, a misdemeanor doesn’t imply any injury to person or property. The section 23152 is specific in dealing with drunken misdemeanors. The penalty for such a crime can be up to 6 months in jail.
The law makes driving after drinking or consuming any other substance that influences the senses unlawful. The phrase ‘Under the Influence’ is much debated, especially since it can’t be clearly defined and symptoms vary from person to person. The commonly accepted definition of under the influence refers to any person who is not fully conscious, tends to stumble, loses coordination or reacts slowly. The definition also includes the partial loss of visual sense.
The law also quantifies the unlawful limit of alcohol as being .08% of the weight of the person. So, you are unfit to drive if you have consumed more alcohol than .08% of your body weight.
A person is required to undergo a chemical test if he or she is arrested under DUI. The results of this chemical test are used as evidence in court. Therefore, the court will consider it as a final proof of your guilt and pass sentence accordingly if you are unable to prove the chemical test results incorrect.
